If a badge required group membership to give out and the group no longer exists, no one would have the permissions to give the badge.
Badges that allowed community awarding continue to exist under the Legacy Group Badge system which explains “ The group that created this badge is no longer available. Since this badge was created for the community to award, it continues to exist as a Legacy Group Badge.” For an example see the “Roaring 20s” badge.
But yes, unfortunately for those badges that did require one be a member of the group — they can’t be given any longer as the group no longer exists to provide that needed access to give — and we will not “override” the original wishes of the creator by allowing other previously unauthorized people to give it.
